1.What data do we collect?

The staff of BYD dealers can register a Di-Mate Account, which is relating to the Di-Mate APP. The information contained in your account includes:

phone number or mailbox;

password;

You can access your BYD Account to update the information from or about you in that account at any time.

We may collect the following data based on the requirements for improving services or analyzing and solving problems:

equipment unique identification information (IMEI);

Your geographical location when using Di-Mate APP;

mobile photo album

We use personal data to manage our services to BYD dealers and customers, to understand customer needs, , and to make our products and services as effective as possible.

Please note that it is unable to identify a specific natural person just with information of individual equipment and operating system,etc. To optimize products, we may analyze non-personal information. If we combine such non-personal information with other non-personal information or personal information to identify a specific natural person, then the non-personal information will be regarded as personal information. Unless authorized by you or required by the law and regulation, we will anonymize the personal information.

3.Who will we share this data with?

When trustees are given access to your personal data, we will take the required contractual, technical and organizational measures to ensure that your personal data are only processed to the extent that such processing is necessary.

In other cases, your personal data will not be supplied to third parties, except where required or allowed by law.

4.To which third countries will we transfer your data?

In principle, the personal data we collect is stored in the countries of your place of residence. However, since BYD is a global company, and we operate internationally, which means we may access from BYD's headquarters in China is supported for the provision of services. By making a purchase or otherwise submitting your personal data to us, you give your consent to transfer information to BYD in the countries other than your place of residence or in which the information was originally collected. BYD complies with laws on the transfer of personal data between countries to help ensure your data is protected as described in this Statement, wherever it may be.

5.What third party services do we use?

The attachment lists the third-party services currently used by BYD and provides links to the privacy policies for each third-party service provider. We do not share your any personal data to the below third parties, we recommend that you read their privacy policies so you can understand the manner in which your personal data will be handled by these third parties.

6.What rights do you have in relation to your data?

You generally have the right to ask us: for access to your personal data that we hold
to update or correct your personal data in order to make it accurate
to delete your personal data from our records in certain circumstances
to object to us processing your personal data in certain circumstances

These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement to process your data or if making the information available to you would reveal personal data about another person or if we are legally prevented from disclosing such information. In some instances, this may mean that we are able to retain data even if you withdraw your consent.

If you no longer want to use Di-Mate Account, you can go to“Personal centre-Account and security-Account cancellation”. After you deregister your account, we will stop providing you with services through your account and will anonymize your relevant Personal Data, provided that anonmization is not otherwise stipulated by special legal requirements.

We hope that we can satisfy any queries you may have about the way we process your data. If you have any concerns about how we process your data you can contact us as described below in the section “If you have any questions about your data”.

In the event you still have unresolved concerns, you also have the right to lodge a complaint with a supervisory authority, in particular the data protection authority in the Member State of your habitual residence or place of work.

Finally, please note that where we require personal data to comply with legal obligations, then provision of such data is mandatory: if such data is not provided, then we will not be able to meet obligations placed on us. In all other cases, provision of requested personal data is optional.

7.How long do we retain your data?

We retain the information we collect from or about you for the period necessary to fulfill the purposes outlined in this Privacy Statement unless a longer retention period is required or permitted by law. When the information is no longer necessary for these purposes, or if you close your account, we will mark your account in our database as “Cancelled”, and we will delete or keep it in a form that does not identify you. When determining this retention period, we take into account various criteria, including the type of services requested by or provided to you, the nature of our relationship with you, the impact on the services we provide to you if we delete some information from or about you, and retention periods required by law.

8.How do we protect your data?

We strive to maintain the highest standards of security and BYD has put in place robust technical and organizational measures for the protection of your data in accordance with the current, general state of technology, especially to protect the data against loss, falsification or access by unauthorized third persons. However the transmission of information via the internet is not completely secure. So, whilst we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted via Di-Mate. Any transmission is at your own risk. Once we have received your personal data we will use strict procedures and security features to prevent unauthorized access. In the unfortunate event that a personal data security incident occurs, we will report it promptly and take remedial measures in accordance with the requirements of the law and regulatory authorities.

If we make changes to this Privacy Statement, we will notify you through Di-Mate. Where changes to this Privacy Statement will have a fundamental impact on the nature of the processing or otherwise have a substantial impact on you, we will give you sufficient advance notice so that you have the opportunity to exercise any rights you have.
